    Crains Detroit Business reports that Cummings was passing out Halloween candy at her cousin's house in Detroit when she encountered a young trick-or-treater in tears because she was cold and only had one glove.

    The situation inspired Cummings to warm up Detroit's needy residents with "Mittens for Detroit." Her charity will "collect and distribute new gloves and mittens to needy Detroit children and adults."

"After the way the city of Detroit has opened its arms to me, the least I can do is give something back," Cummings said.

Southfield Lawyer’s annual Bucket List for 2011 includes – Slaying a Dragon?

Joe Jackson accuses AEG – and others – of keeping Michael away from family– the estate planning magic and tricks to make sure this doesn’t happen to you.


 

Imagine this: Dr. Murray – the now infamous Dr. who may be indicted for Michael Jackson's death – was one of a few enablers around Michael Jackson. But who hired him? Did AEG hire him? We take a look at how this might affect the average 'Joe' family.

We set out to address questions you have asked time and time again. Is there anything you can do before a family member dies and their assets are siphoned off. If you wait too long, there may be very little one can do.


 

"We typically see this with elderly clients. One family member has access and motive to make sure Mom or Dad's bank accounts, insurance, or other assets are not all of a sudden changed to that child's name." States Joseph J. He reiterated a few key points for our readers/listeners, "There is a list of items a family should be weary of to decide if a conservatorship is needed over the elderly family member"

1.    Does individual drive?

2.    How often is the enabler over their home? Do they take them everywhere? Including Dr's, other lawyers?

3.    Do they have name on bank account as co-signer?

4.    Does the individual always keep elderly away from others? Ie. Do your phone calls get returned? Is there always 'something' when you try to go over to their home/apartment?

5.     Does this individual have ALL documents or mail sent to their own home? (you should check with a fake letter and see where the mail goes)

6.     Who takes them to the Dr's office? Who gets their prescriptions?

"These are all factors to watch out for when a loved one may be in harm's way. With Dr. Murray it's being alleged that AEG did not allow others to be around Michael Jackson for some period of time (check out Larry King to Nancy Grace and Bill O'Reilly are all still talking about Michael Jackson). Even Michael's dad – Joe Jackson – is now alleging that AEG had something to do with the death."

"The trick here is if you or a loved one feels this way you need to get a conservatorship – or at least petition the probate court in that county. ."

Dane Cook gone crazy? As his comedy would dictate, he is now getting some of his emotions out in the open, from having his parents pass away in the past couple years, and it makes for great comedy. (along with a perfect time to actually do some planning). Read more below…

Can you imagine having a parent tell you they have 'Cancer'? I know many family's go through this in America. "His best option would be to create a VIP Revocable Living Trust to be able to control her assets, nominate who he wants to control his hard-earned assets. But this only hits half the battle."


 

He went on to further state "One key critical item is to get this all done before she loses her mental capacity or a court may decide. (after all we did just see Bret Michaels (Rock of Love, VHI show http://www.vh1.com/shows/rock_of_love/season_3/series.jhtml) where he was hit on the head, broke his nose." Further, the other matter comes with a potential Estate Tax to the government (which starts at 48% of assets over $3.5mm; but it gets worse as you'll see later) and who pays it. Do you think Dane wants to pay the government any more than he has to? Moreover, he has to be careful that if her Trust names a Charity as a beneficiary it may cause her IRA/Retirement Plan to be taxed up to 70% of it's value and paid out almost immediately. So as you can see if proper planning is not provided it can be disastrous."

3 Myths about your ‘Living Will’ that will knock your socks off!

If there is one Estate Document you give your fullest attention to, it should be your Living Will. Consider the possibilities. You (or one you love) are hospitalized, helpless, and unable to speak for yourself. Doctors, nurses and your family members are making critical decisions on your behalf. Should you be kept on a respirator? Should a feeding tube be inserted? You could even be drifting in and out of consciousness during this process – aware of what is going on but completely unable to do anything about it.


 

Your might know now what you do and do not want done, but if you haven't put it in writing, all bets are off.


 

Your Living Will is the document that directs what your end-of-life wishes are: Do you want to stay on life-support? Do you want a breathing tube used? Should you be given food or water?


 

"Food and water," you may ask:

"What's that got to do with it?"

YOU MAY BE JUST LIKE MANY OF OUR CLIENTS:

Terri Schiavo case?


 

The problem here was that Mrs. Schiavo had never prepared a Living Will. Her husband claimed to have had conversations with her that included her wishes not to be kept on life-support. But without the correct documentation, such evidence was not considered adequate.

Myths about the Living Will –


 

Myth One: This is the document that states how you want your property to go upon your passing.

Myth 2 – This is the document that nominates your personal representative.


 

Neither one of these is true.

Way too many of the documents I review are slapped together with no customization. This can cause families to fight and eventually fall apart. Also, if your current Living Will is too old, it may be out of date. This could mean some health care institutions might not even honor it!

Estate Planning is ALL about OPTIONS. It's like the trail you used to take going home from school when you were a child. If you went one way, the bully and his gang might have been there. What's this about food and water . . . the basic elements of life? In my experience, more than 98% of Wills and Trusts I review DO NOT have this basic item. Go look at your Medical Health Care Directive and Living Will. Find out if you will have food and water as part of your end-of-life care.


 

Or consider this: Mom is in a second marriage with "Casanova"? Who makes the decisions? You want what's best for Mom, but the new beau may want something else.


 

Family members would obviously say, "We thought Mom wanted to make sure she had food and water to sustain her? But her . . .


 

    LARGE PROBATE COSTS ARE THE END RESULT


 

Keep these points in mind:

Make sure you're the one calling the shots in the hospital room. No one needs this kind of problem!


 

  • A Living Will should say if you want to be kept alive by a feeding tube or not. But Living Wills signed before July, 1991 don't talk about being in a coma or being fed by tubes.
  • There is an alarming trend to define food and water as "medical
    treatments" which can be considered optional for a given patient rather than ordinary care to which all are entitled.
  • Today patients are in more danger of under-treatment than overtreatment, especially dependent persons in institutionalized situations. There are major financial incentives for health care providers to undertreat patients.
  • A Poorly drafted Living Will may weigh the law in favor of death rather than life. Yours may not give you the power to choose life saving treatment or even food and water.
  • Today's hospital patients, (even if they are non-terminal) are in increasing danger of being deprived of beneficial medical treatment and even food and water.

Why Suze Orman, among others, are dead wrong about Estate Planning

I'm not sure if it's a part of the brain that tells someone ' I have to tell everyone everything I know and everything I think I know.' That is the case with this misleading part of Suze Orman's new book (Money and something, I can't seem to recall) it's on page 175 in case someone is questioning what I'm talking about.

First off, I'm not sure when she received her J.D., pass a bar exam, practice law, created an estate planning system to protect a family's assets, but it seems someone of her persuasion should know better. It's bad enough I've seen financial advisors (whom I respect) have clients that actually show me their 'Medical Power of Attorney' that was provided to them from their advisor. And if you didn't catch this part, financial advisors should never be in the business of providing legally binding documents or attempting to quote prices just because (well Jimmy down the street sells them for xzy.')

And I know we all have 'bad apples' in our groups, but this is not just misleading, the consequences could make sure a loved one doesn't get the proper medical advice or worse yet, access to medical documents 'when they need it.' I'll get to that a little bit,

2ndly, she actually states 'there are 3 main estate planning documents' which is the worse legal estate planning advice an estate planning attorney could make (and many of you who are clients know about our '20 Minute Emergency Estate Planning Blueprint'tm that I created so you are empowered with this knowledge and should pass it on, I digress) let alone a financial advisor with a large audience.

Here is the key, There are at least '5 Critical Documents' Will, Trust, VIP financial power of attorney, Medical Healthcare Power of Attorney, and the only form that can actually save your life 'Life-Saving Medical Release Document', if you have small kids, you need to go above and beyond just naming 'guardians/conservators' we created a program called 'Emergency Child Protection Program'tm to name emergency responders and temporary guardians, not to mention a whole planning kit to describe how your kids should be raised when you are gone.

I don't think I read ANY OF THAT, in the alleged guru's book, in fact I know it's not there.
